On October 22, 2019, our firm filed a Complaint against Federal Express Corporation and FedEx Ground Package System, Inc. (collectively, “FedEx”). The Complaint alleges that FedEx unfairly denied overtime wages to Security Specialist IIs, Security Specialist IIIs and Senior Security Specialists (collectively, “Security Specialists”). Plaintiff filed her Complaint on behalf of herself and other “similarly situated” Security Specialists who worked in the aforementioned positions at any time within the past three (3) years prior to October 22, 2019.
The Complaint alleges that FedEx misclassified its Security Specialist IIs, Security Specialist IIIs and Senior Security Specialists as exempt from overtime, paying them a salary when they did not satisfy any of the exemptions under the Fair Labor Standards Act (“FLSA”). We are seeking to recover unpaid overtime wages for all hours worked over forty (40) in a workweek on behalf of these employees. In addition, our firm seeks to recover liquidated (double) damages and other statutorily-permitted relief for all of these employees.
