On October 24, 2018, our firm filed a Complaint against Helion Technologies, Inc. (Helion). The Complaint alleges that Helion unlawfully denied overtime payments to its Desktop Support Technicians/Engineers, Systems Support Technicians/Engineers, Outsource Field Technicians/Specialists and other employees who held similar titles (collectively, Technicians). Plaintiffs filed their Complaint on behalf of themselves and other “similarly situated” employees who worked in these positions at any time within the past three (3) years.
The Complaint alleges that Helion intentionally misclassified Technicians as salaried employees rather than hourly employees and in doing so, failed to pay Technicians overtime (“time-and-a-half”) wages when they worked more than forty (40) hours in a workweek. Plaintiffs allege that this is a direct violation of the Fair Labor Standards Act (FLSA).
The Complaint also alleges that although Helion converted some of its Technicians from salaried to hourly employees, those Technicians are still owed wages due to their failure to receive any back pay for the overtime hours they worked when they were salaried.
Our firm seeks to recover unpaid overtime wages and liquidated (double) damages for all of these employees.
