taking order at a restaurantOn January 24, 2019, our firm filed a Complaint against Landry’s, Inc. (Landry’s), d/b/a Bubba Gump’s Shrimp Co. The Complaint alleges that Landry’s unfairly compensated its servers and bartenders by denying them the correct minimum and overtime wage payments when they performed work that did not give them the opportunity to earn tips for more than twenty percent (20%) of their time each week. Plaintiffs filed their Complaint on behalf of themselves and other severs and bartenders who worked at Landry’s within the past three (3) years.

Plaintiffs allege that at all times throughout their employment, they were only paid the minimum hourly-tip credit, despite the fact that much of their work did not provide them with the opportunity to earn tips. Plaintiffs allege that a large part of their work consisted of having to wash dishes, clean the restaurant and perform other custodial duties. Plaintiffs allege that they performed these duties for long periods throughout their shifts. They have also alleged that Landry’s required them to perform some of these duties while they were off the clock. Based on these violations, our firm seeks to recover treble (triple) damages and other statutorily-permitted relief for Plaintiffs and all other servers and bartenders who experienced similar harms.

If you worked as a bartender or server for Landry’s or Bubba Gump Shrimp Co. between January 2016 and the present, you may have a potential claim. To learn more about this case, please contact us.
