On May 9, 2019, our firm filed a Complaint against Paychex, Inc. (Paychex). The Complaint alleges that Paychex unfairly denied overtime payments to its Implementation Coordinators and Implementation Project Managers. Plaintiffs filed their Complaint on behalf of themselves and other “similarly situated” employees who worked in either position at any time within the three (3) years prior to May 2019.
The Complaint alleges that Paychex misclassified its implementation personnel as exempt from overtime and paid them a salary rather than an hourly wage, despite the fact that they did not satisfy any of the exemptions under the Fair Labor Standards Act. According to the Complaint, Implementation Coordinators, Implementation Project Managers and other implementation personnel spent most of their time performing routine customer service tasks associated with hourly positions rather than administrative or executive duties.
Our firm is seeking to recover unpaid overtime wages on behalf of these personnel. In addition, our firm seeks to recover liquidated (double) damages and other statutorily-permitted relief for all of these employees.
