On August 31, 2017, our firm filed a Complaint against Pure Technologies U.S., Inc. (“Pure Technologies”). The Complaint alleges that Pure Technologies unlawfully denied overtime payments to its field technicians, field operators, field engineers and project engineers (collectively, “field personnel”). Plaintiffs filed their Complaint on behalf of themselves and other “similarly situated” employees who worked in these positions at any time within the past three (3) years.
The Complaint alleges that Pure Technologies intentionally misclassified field personnel as salaried employees rather than hourly employees and in doing so, failed to pay them overtime (“time-and-a-half”) wages when they worked more than 40 hours in a workweek. Plaintiffs allege that this is a direct violation of the Fair Labor Standards Act. Our firm seeks to recover unpaid overtime wages and liquidated (double) damages for all of these employees.
