On July 31, 2017, our firm filed a Complaint against Safelite Group, Inc. (Safelite). The Complaint alleges that Safelite unlawfully denied overtime payments to its Technicians. Plaintiffs filed their Complaint on behalf of themselves and other “similarly situated” Technicians who worked in this position at any time within the three (3) years prior to July 2017.
Plaintiffs’ and other Technicians’ duties ranged from the full removal of windshields and windows to routine repairs and maintenance. They were paid an hourly rate as well as commissions.
The Complaint alleges that Safelite implemented an illegal policy throughout the entire Mid-Atlantic region, including Maryland, Delaware and Virginia. Regardless of how many hours Safelite’s Technicians worked each week, they were instructed to only report 40 hours or less. Consequently, Safelite failed to pay its Technicians proper overtime (“time-and-a-half”) wages. Plaintiffs allege that this was a direct violation of the Fair Labor Standards Act (FLSA).
Our firm seeks to recover unpaid overtime wages and liquidated (double) damages for all of these employees.
