On August 23, 2019, our firm filed a Complaint (Civil No. 19-cv-01125) against Shawmut Design and Construction (“Shawmut”). The Complaint argues that individuals employed in Defendant’s Construction Management Skills Training Program (“CMST”) who held the title of Assistant Project Manager, Assistant Superintendent and/or Assistant Estimator (collectively, “Assistant(s)”) were not properly compensated for their overtime hours worked. Plaintiff filed the Complaint on behalf of himself and other salaried Assistant Superintendents who worked or work in Shawmut’s CMST program during the last three (3) years.
The Complaint argues that Shawmut willfully misclassified its Assistants Superintendents as salaried exempt employees, despite the fact they did not satisfy any of the exemptions under the Fair Labor Standards Act (“FLSA”). We are seeking to recover unpaid overtime wages for each week that salaried Assistants worked over forty (40) hours. Our firm also seeks to recover liquidated (double) damages and other statutorily-permitted relief for these employees.
