On November 20, 2019, our firm and Nichols Kaster, LLP filed a Complaint (3:19-cv-07647) against Tyler Technologies (“Tyler”). The Complaint alleges that Implementation Consultants and Implementation Coordinators (“Implementation Reps”) employed at Tyler were not properly compensated for their overtime hours worked. Plaintiff filed his Complaint on behalf of himself and other salaried Implementation Reps who work or worked at Tyler at any time within the last three (3) years.
The Complaint alleges that Tyler willfully misclassified Implementation Reps as salaried employees, despite the fact they did not satisfy any of the exemptions under the Fair Labor Standards Act (“FLSA”). We are seeking to recover unpaid overtime wages for each week that salaried Implementation Reps worked over forty (40) hours. Our firm also seeks to recover liquidated (double) damages and other statutorily-permitted relief for these employees.
