On August 19, 2020, current and former employees (“Plaintiffs”) of Zayo Group Holdings, Inc. (“Zayo”) filed a Complaint (Case No.: 1:20-cv-02490, U.S. District Court for the District of Colorado) against their former employer, alleging violations of the Fair Labor Standard Act (“FLSA”). Plaintiffs are represented by the Law Offices of Peter T. Nicholl and Nichols Kaster, PLLP. The Complaint alleges that Service Delivery Coordinators (“SDCs”) were not properly compensated for their overtime hours worked. Plaintiffs filed their Complaint on behalf of themselves and all other salaried SDCs who work or worked for Zayo at any point within the last three (3) years.
The Complaint further alleges that Zayo improperly misclassified all of their SDCs as salaried employees, despite the fact they did not satisfy any of the exemptions under the FLSA. Plaintiffs are seeking to recover unpaid overtime wages for each week that Plaintiffs and other SDCs worked over forty (40) hours. Plaintiffs also seeks to recover liquidated (double) damages and other statutorily-permitted relief.
