The complaint was filed on Oct. 23, 2018, in the United States District Court for the District of Maryland (Northern Division) on behalf of two employees and all similarly situated employees. The main allegation in the complaint is that Helion Technologies, an information technology service company that provides support to car dealerships, did not provide overtime compensation to the following types of employees:
According to the complaint, the company intentionally misclassified these positions as salaried instead of hourly. The company then failed to pay these employees time-and-a-half for hours worked over 40 in a week. This violates the Fair Labor Standards Act (FLSA), the federal law that sets minimum wage and overtime pay requirements.
Helion changed the classification of some technicians so they would be considered hourly employees. However, the complaint says these reclassified employees are still owed backpay for the overtime hours they worked when they were classified as salaried.
Anyone who was a desktop support technician/engineer, systems support technician/engineer, outsource field technician/specialist or performed duties similar to these positions at any point in the last three years and was not paid overtime for overtime hours worked may be able to join this class action.

Under the FLSA, all employees who are non-exempt must be paid one and a half times their regular rate of pay for any hours worked over 40 in a work week. In other words, if you make $15 per hour, your employer must pay you $22.50 per hour for every overtime hour worked in a week.
The law prohibits employers from paying you for the average number of hours you worked in a two-week period. Otherwise, an employee could work over 40 hours one week and 40 hours or less the next week and the employer could pay the person for the average hours worked. This would allow employers to get out of paying overtime.
However, the law includes a variety of exemptions for employees who fit certain criteria. Employers are not required to pay these employees overtime when they work more than 40 hours in a week.
For example, certain computer employees are exempt from overtime, including those who receive at least $455 per week or $27.63 per hour and work as computer systems analysts, computer programmers, software engineers or in positions that use similar skills and perform the following duties:

When employees are denied overtime wages they are entitled under the law, they may decide to take legal action to recover those wages. You worked overtime hours and you deserve to be paid what the law says you should be paid.
However, employees often do not realize they may be entitled to liquidated damages from their employer. Liquidated damages are equal to the amount of unpaid wages. For example, if an employee is owed $2,000 in overtime wages, he or she may also be owed $2,000 in liquidated damages.
If you join the Helion class action, our attorneys can also pursue compensation for attorney fees and court costs, to cover our costs for investigating and filing the lawsuit and any costs incurred by the court.

Employers who do not pay their employees the overtime wages they are entitled to should be held accountable for violating the FLSA. Employees should also be awarded the compensation they are owed for being denied wages.
