The complaint was filed on Oct. 23, 2018, in the United States District Court for the District of Maryland (Northern Division) on behalf of two employees and all similarly situated employees. Under the FLSA, all employees who are non-exempt must be paid one and a half times their regular rate of pay for any hours worked over 40 in a work week. In other words, if you make $15 per hour, your employer must pay you $22.50 per hour for every overtime hour worked in a week.
The law prohibits employers from paying you for the average number of hours you worked in a two-week period. Otherwise, an employee could work over 40 hours one week and 40 hours or less the next week and the employer could pay the person for the average hours worked. This would allow employers to get out of paying overtime.
