The Complaint alleges that Clayton Homes unfairly denied overtime payments to its Homes Sales Consultants and other inside sales employees. Plaintiffs filed their Complaint on behalf of themselves and other Home Sales Consultants who were employed by Clayton Homes within the last three (3) years.

The Complaint alleges that Clayton Homes misclassified its Home Sales Consultants as exempt from overtime and paid them a salary, even though they did not satisfy any of the applicable legal tests. According to the Complaint, Home Sales Consultants did not earn enough in commissions to be exempt from the overtime requirements, but were required to work overtime regularly.

We are seeking to recover unpaid overtime wages for all weeks that Plaintiffs and other Home Sales Consultants worked over forty (40) hours. Our firm also seeks to recover liquidated (double) damages and any other available relief for these employees.
