On September 5, 2019, our firm filed a Complaint against U.S. Foods, Inc. (U.S. Foods). The Complaint alleges that U.S. Foods unfairly denied overtime wages to its Buyers. Plaintiffs filed their Complaint on behalf of themselves and other “similarly situated” Buyers who worked in this position at any time within the past three (3) years prior to September 2019.
The Complaint alleges that U.S. Foods misclassified its Buyers as exempt from overtime, paying them a salary when they did not satisfy any of the exemptions under the Fair Labor Standards Act (FLSA). We are seeking to recover unpaid overtime wages for all hours worked over forty (40) in a workweek on behalf of these Buyers. In addition, our firm seeks to recover liquidated (double) damages and other statutorily-permitted relief for all of these employees.
