On January 8, 2019 our firm filed a Complaint against Athelas Institute, Inc. (Athelas). The Complaint alleges that Athelas unfairly denied overtime payments to its House Managers. Plaintiffs filed their Complaint on behalf of themselves and other “similarly situated” employees who worked in this position at any time within the past three (3) years prior to January 2019.
The Complaint alleges that Athelas misclassified House Managers as exempt from overtime, paying them a salary when they did not satisfy any of the exemptions under the Fair Labor Standards Act. According to the Complaint, House Managers spent most of their time performing general labor tasks associated with hourly staff positions rather than management or executive duties. We are seeking to recover unpaid overtime wages for the hours worked over 40 in a workweek on behalf of these House Managers. In addition, our firm seeks to recover liquidated (double) damages and other statutorily-permitted relief for all of these employees.
