On April 11, 2016, our firm filed a Complaint against Servis One, Inc., more commonly known as BSI Financial Services, Inc. (“BSI”). The Complaint alleges that BSI unlawfully denied overtime payments to its Asset Managers, intentionally misclassifying them as salaried employees rather than hourly employees. The Complaint alleges that in doing so, BSI failed to pay them overtime (“time-and-a-half”) wages when they worked more than 40 hours in a workweek. Plaintiffs allege that this is a direct violation of the Fair Labor Standards Act (FLSA).
On March 11, 2019, the Court authorized this matter as a class action. This means that all Asset Managers who worked for BSI at any time since April 11, 2013 in Maryland will be automatically included in the case as class members. Notice of Class Certification will be disseminated soon, at which time eligible special investigators will be notified of their inclusion in the case as a class member, and they will have to affirmatively opt-out of the lawsuit if they do not want to be included.
