On September 18, 2017, our firm filed a Complaint against JLN Construction Services, LLC (JLN). The Complaint alleges that JLN unlawfully and consistently denied proper overtime payments to its laborers and foremen and also failed to pay them for all hours of work. Plaintiffs filed their Complaint on behalf of themselves and other “similarly situated” employees who worked in these positions at any time within the three (3) years prior to September 2017.
Plaintiffs and other similarly situated employees were classified as hourly employees and their duties consisted primarily of manual labor.
Plaintiffs and other similarly situated employees often worked over 40 hours each week but did not always receive time and a half (1.5) their regular rate of pay for all overtime hours. During certain weeks, Plaintiffs and other similarly situated employees did not receive any overtime pay. During other weeks, they only received overtime pay for a portion of their overtime hours. At other times, JLN would not property calculate an overtime rate based on their correct prevailing or scale wage. Plaintiffs allege that JLN’s improper pay practices are a direct violation of the Fair Labor Standards Act (FLSA).
