On February 16, 2022, our firm and Nichols Kaster, LLP filed a Complaint (1-22-cv-00064) against OpSec Security, Inc. and OpSec Online, LLC (collectively “OpSec”). The Complaint alleges that OpSec unlawfully denied overtime payments to Brand Analysts, Senior Brand Analysts and employees who held similar positions. The Complaint was filed on behalf of a former employee (“Plaintiff”) and other similarly situated employees who held any of the positions mentioned above at any time within the past three (3) years.
The Complaint alleges that OpSec willfully misclassified Brand Analysts, Senior Brand Analysts and others similary situated as salaried employees, despite the fact they did not satisfy any of the exemptions under the Fair Labor Standards Act (“FLSA”). We are seeking to recover unpaid overtime wages for each week that Brand Analysts, Senior Brand Analysts and similarly situated employees worked over forty (40) hours. Our firm also seeks to recover liquidated (double) damages and other statutorily-permitted relief for these employees.
