On Friday December 3, 2021, our firm and Nichols Kaster, PLLP filed a Complaint (2:21-cv-09390) against TransPerfect Translations International, Inc. (“TransPerfect”). The Complaint alleges that TransPerfect unlawfully denied overtime payments to Project Managers, Senior Project Managers, Executive Project Managers and other positions with similar titles and/or duties (collectively, “Project Managers”). The Plaintiff filed her Complaint on behalf of herself and other “similarly situated” employees who worked in these positions at any time within the past three (3) years.
The Complaint alleges that TransPerfect willfully misclassified Project Managers as salaried employees, despite the fact they did not satisfy any of the exemptions under the Fair Labor Standards Act (“FLSA”). We are seeking to recover unpaid overtime wages for each week that salaried Project Managers worked over forty (40) hours. We also seek to recover liquidated (double) damages and other statutorily-permitted relief for these employees.
